This Privacy Policy explains how Daybreak Process Serving, LLC (“Daybreak,” “we,” “us”) collects, uses, shares, and protects information in connection with:
- our marketing website;
- our client portal, where clients place and track orders and pay invoices;
- our mobile field application, used by our servers and contractors; and
- the process serving and related services we provide.
By using any of these, you agree to this Policy. If you do not agree, please do not use our website, portal, app, or Services.
Information you provide. When you request a quote, place an order, contact us, apply for a job, or create an account, we may collect:
- contact details (name, email, phone, company);
- case and recipient information and the documents you upload for service or filing;
- billing information and payment details. When you pay, or choose to save a card for future use in the client portal, your card is collected and stored securely by our payment processor (Stripe). We keep only a secure token and limited details such as the card brand and last four digits — never the full card number, which we cannot see;
- account credentials, and electronic signatures or agreement acknowledgements;
- for job applicants: your work history, availability, and any resume you attach.
Information collected automatically. When you use our website or apps, we and our providers may collect device and log data (such as IP address, browser or device type, and pages viewed) and information through cookies and similar technologies (see Cookies & Tracking below).
Mobile app information. Our field app, used by servers, collects — with the appropriate device permissions — precise GPS location (to stamp the location of a service attempt), photos you capture as evidence of an attempt, and a push notification token to deliver job alerts.
Information from third parties. For address locating and skip tracing, we use public and private data sources to help locate a subject.
- To provide, complete, and document the Services you request, including generating affidavits of service.
- To route, schedule, and log service attempts, and to notify you of progress.
- To process payments, send invoices, and collect amounts owed.
- To create and secure accounts, and to provide customer support.
- To evaluate job applications.
- To improve our website, apps, and Services, and to keep them secure.
- To comply with legal obligations and enforce our Terms.
In the ordinary course of process serving, we necessarily handle information about the individuals being served (such as names, addresses, and details recorded during an attempt). We process this information for the legitimate purpose of effecting and documenting legal service, on behalf of our clients, and we limit its use to that purpose.
We keep information for as long as needed to provide the Services, maintain accurate business and legal records (including affidavits and proof of service), resolve disputes, and comply with our legal obligations. Retention periods vary by record type and applicable law. When information is no longer needed, we take reasonable steps to delete or de-identify it.
We use reasonable administrative, technical, and physical safeguards to protect information, including encryption in transit. No method of transmission or storage is completely secure, however, and we cannot guarantee the security of electronic communications. Please keep your account credentials confidential.
- Access & correction. You can request a copy of the personal information we hold about you, or ask us to correct it.
- Deletion. You can request deletion of your personal information, subject to records we must keep by law or for legitimate business purposes.
- Marketing. You can opt out of non-essential messages at any time; we will still send service-related communications about your orders.
- California residents. Consistent with the CCPA/CPRA, you may request access to or deletion of your personal information and are entitled not to be discriminated against for exercising these rights. We do not sell or share personal information for cross-context behavioral advertising.

Our field app requests only the permissions needed to do the job, and only from our servers and authorized contractors:
- Location — to record where a service attempt took place. You can control location access in your device settings.
- Camera & photos — to attach evidence photos to an attempt.
- Notifications — to deliver job assignments and alerts.
You can revoke any of these permissions at any time in your device settings, though doing so may limit app functionality. Daybreak does not track users across other companies' apps or websites, and shows no ads.
This section applies to California residents and supplements the rest of this Policy, consistent with the California Consumer Privacy Act, as amended by the CPRA. In the past 12 months, we have collected the categories of personal information described in Information We Collect above — for example identifiers and contact details, commercial/transaction information, internet and device activity, precise geolocation (mobile app), visual information (evidence photos), and professional information (job applicants). We collect this from you, from your devices, and from public and private data sources used for skip tracing.
We use and disclose this information for the business purposes described in How We Use Information and How We Share Information — namely, to provide and document the Services, operate our platform through service providers, and meet legal obligations.
Subject to certain exceptions, California residents have the right to:
- Know / access the categories and specific pieces of personal information we have collected about them;
- Delete personal information we have collected;
- Correct inaccurate personal information;
- Opt out of any sale or sharing (not applicable, since we do neither) and limit the use of sensitive personal information to what is necessary to provide the Services;
- Non-discrimination — we will not deny service, charge a different price, or provide a different quality of service for exercising these rights.

We will verify your request using information associated with your account or order, and you may use an authorized agent to submit a request on your behalf with proof of authorization. California's “Shine the Light” law does not apply because we do not share personal information with third parties for their own direct marketing.
Our website, apps, and Services are intended for adults and are not directed to children. We do not knowingly collect personal information from children under 13 (or under 18 for account holders). If you believe a child has provided us information, please contact us and we will delete it.
Our website and apps may link to or embed third-party services (for example, Google Maps or our payment processor's checkout). Their handling of your information is governed by their own privacy policies, and we encourage you to review them. This Policy applies only to Daybreak.
We may update this Policy from time to time. When we do, we will revise the “Last updated” date above, and significant changes may be highlighted on our website. Your continued use of our website, apps, or Services after an update means you accept the revised Policy.
